Last week Judge Fallon awarded the 6 plaintiffs in the Chinese Drywall case $2.6 million in damages.  Although this is certainly a victory of sorts, whether they will actually be able to collect remains to be seen.  While not diminishing the value of the verdict to the plaintiffs, the more long reaching effect of this judgment is that it establishes a protocol for the remediation of homes containing corrosive drywall.  While we believe that every house will need to be evaluated on it’s own merits and a protocol written specifically for it, this establishes a “worst Case”.  Both the NAHB and the CPSC have issued guidelines for remediation, and this ruling is not far off.  The Findings of Fact and Conclusions of Law (Click here to download PDF) makes some effort and comparing and explaining differences.

Our approach to remediation is to examine the home in question closely and then develop a specific protocol using these three documents as well as others that have been developed.  Anyone conducting inspections and remediation should be familiar with these documents.
